Agreement
By downloading, installing, or using the Orbit Mac app, or by accessing this website, you agree to these Terms of Service. If you do not agree, do not use Orbit or this website.
The Orbit App
Orbit is a macOS application that displays your travel history as a live globe wallpaper. You are responsible for the accuracy of the data you add. The app is provided "as is" and we do not guarantee uninterrupted or error-free operation. Orbit requires macOS 13 (Ventura) or later.
License
We grant you a limited, non-exclusive, non-transferable license to use Orbit for personal, non-commercial use. You may not reverse engineer, decompile, or attempt to extract the source code of the app, except as permitted by applicable law.
In-App Purchases
Orbit may offer paid features (e.g., Pro annual or lifetime subscriptions) through Apple's App Store. Purchases are subject to Apple's terms and conditions. Refunds are handled by Apple according to their policies. We reserve the right to modify pricing or discontinue offerings with reasonable notice.
Acceptable Use
You agree not to use Orbit or this website for any unlawful purpose, to violate any applicable laws, or to infringe on the rights of others. You may not use the app to distribute malware, spam, or harmful content.
Intellectual Property
Orbit, its name, logo, and all related content are owned by us or our licensors. You may not use our trademarks or branding without prior written permission.
Disclaimer of Warranties
ORBIT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP OR WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF ORBIT OR THIS WEBSITE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR ORBIT IN THE TWELVE MONTHS PRECEDING THE CLAIM, IF ANY.
Termination
We may suspend or terminate your access to Orbit or this website at any time, with or without cause or notice. Upon termination, your right to use the app and website ceases. Provisions that by their nature should survive (e.g., disclaimers, limitations of liability) will survive.
Changes
We may update these terms from time to time. We will post the updated terms on this page and update the "Last updated" date. Continued use of Orbit or this website after changes constitutes acceptance of the updated terms. If you do not agree, you must stop using the app and website.
Company
Orbit is a product of Alpha Portfolio Ventures, LLC, a Delaware limited liability company.
Governing Law
These terms are governed by the laws of the State of Delaware and the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in Delaware.
